Privacy Policy

1. Who We Are

Consult NTA ("Consult NTA," "we," "us," or "our") is a consultancy located in California, United States. We operate the website consultnta.com (the "Site") and provide digital advertising and lead-generation services to business clients, including real-estate professionals.

For the personal information described in this policy, Consult NTA is the business (data controller) responsible for how that information is collected and used, except where we act as a service provider on behalf of a client, as described in Section 3.

2. Information We Collect on Our Website

Analytics — PostHog

We use PostHog, a product analytics service hosted in the United States, to understand how visitors use the Site. PostHog collects:

  • Pages you visit and how you navigate between them, including session replay (a visual reconstruction of your visit with everything you type masked)
  • Interactions with page elements, such as clicks and form interactions (autocapture)
  • Device and browser information, screen size, and approximate location derived from your IP address
  • Technical error information if something on the Site breaks (exception capture)

PostHog data is sent through our own domain (a first-party endpoint at consultnta.com/ingest) and then delivered to PostHog's US servers. PostHog may set cookies or use browser storage to recognize your browser across visits. Session replay is configured to mask everything you type: the contents of form fields and other inputs are never recorded. Replay data is retained for 30 days, and IP addresses are not stored with analytics events.

Analytics — Plausible

We also use Plausible Analytics, a privacy-focused analytics service, to measure aggregate site traffic (page views, referral sources, country, device type). Plausible does not use cookies and does not track individual visitors across websites.

Information you provide directly

If you contact us by email or through a form on the Site, or create a client portal account, we collect the information you choose to send, such as your name, email address, company, project details, and message contents.

Payment and hosting providers

The Site is hosted on Vercel, whose infrastructure processes standard server logs (including IP addresses) to deliver the Site. If you purchase services from us, payment is processed by Stripe; we do not store your full payment card details.

3. Information We Process Through Our Advertising Services

Separately from the Site, Consult NTA runs advertising campaigns on Meta platforms (Facebook and Instagram) on behalf of business clients, primarily real-estate professionals. As part of these campaigns, prospective home buyers and sellers may submit their information through Meta Instant Forms (lead ads that appear on Facebook or Instagram).

What we collect

When you submit a Meta Instant Form on an ad we manage, we receive from Meta the information you entered, which may include your name, email address, phone number, and stated preferences such as property interests, budget range, timeline, or showing availability.

Source of this information: Meta Platforms, Inc., via the Meta Marketing API, based on the form you submitted on Facebook or Instagram.

How we use it and who receives it

We collect this lead information on behalf of the specific client whose ad you responded to (for example, a real-estate agent or brokerage). We deliver your information to that client so they can respond to your inquiry. The client is responsible for their own subsequent use of your information under their own privacy practices.

We use lead data ourselves only to operate and improve the advertising campaigns (for example, delivering leads reliably, measuring campaign performance, and troubleshooting). We do not sell lead-form data, and we do not use it to advertise unrelated products to you.

Your submission of a Meta Instant Form is also governed by Meta's own Privacy Policy.

4. Cookies and Tracking Technologies

The Site uses cookies and similar technologies (such as browser local storage) as follows:

Strictly necessary

Hosting, security, and authentication (Vercel, Supabase). Required for the Site to function, including secure login and checkout.

Analytics (PostHog)

Cookies or local storage that recognize your browser across visits and measure how the Site is used, including page views, clicks, and errors.

Analytics (Plausible, cookieless)

Aggregate traffic measurement. Sets no cookies and stores no persistent identifier on your device.

You can control cookies through your browser settings, including blocking or deleting them. You can also opt out of analytics tracking as described in Sections 8 and 9 below. Because PostHog is served through our own domain, some browser tracker-blocking tools may not detect it automatically; the opt-out methods in this policy apply regardless.

We do not use third-party advertising cookies or advertising pixels on the Site.

5. How We Use Personal Information

  • To operate, maintain, secure, and improve the Site and our services
  • To understand how visitors use the Site (analytics) and fix errors
  • To respond to inquiries and communicate with you
  • To deliver lead information to the client whose advertisement you responded to (Section 3)
  • To measure and improve the performance of advertising campaigns we manage
  • To process transactions and send related information
  • To comply with legal obligations and enforce our agreements

6. How We Share Personal Information

We share personal information with:

  • Our clients: lead-form information is delivered to the specific client on whose behalf the advertisement ran, as described in Section 3.
  • Service providers: PostHog (analytics), Plausible (analytics), Vercel (hosting), Supabase (database and authentication), Stripe (payment processing), Resend (email delivery), and Meta (advertising platform and source of lead data). These providers process information under contracts that restrict their use of it.
  • Legal and safety: when required by law, legal process, or to protect the rights, safety, or property of Consult NTA, our clients, or others.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, subject to this policy.

We do not sell your personal information for money. Some analytics disclosures may qualify as "sharing" for cross-context purposes under California law; Section 8 explains how to opt out.

7. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), gives you the following rights:

  • Right to know: request disclosure of the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom it was shared.
  • Right to delete: request that we delete personal information we collected from you, subject to certain exceptions.
  • Right to correct: request that we correct inaccurate personal information we maintain about you.
  • Right to opt out of sale or sharing: direct us not to sell your personal information or share it for cross-context behavioral advertising. See Section 8.
  • Right to limit use of sensitive personal information: we do not use sensitive personal information for purposes requiring a right to limit, but you may contact us with any concerns.
  • Right to non-discrimination: we will not deny you services, charge you a different price, or provide a different level of quality because you exercised any of these rights.

How to exercise your rights

Email us at nick@consultnta.com with the subject line "California Privacy Request" and tell us which right you want to exercise. We will confirm receipt within 10 business days and respond within 45 calendar days (extendable once by an additional 45 days where reasonably necessary, with notice to you).

We will verify your identity by matching the information in your request against information we already hold (for example, the email address associated with a lead submission). You may designate an authorized agent to submit a request on your behalf; we may require proof of the agent's authority and verification of your identity.

If your personal information reached us through a lead form submitted for one of our clients, we may fulfill your request directly, forward it to the relevant client, or both, depending on who controls the information.

8. Do Not Sell or Share My Personal Information

We do not sell personal information in exchange for money. However, California law defines "sale" and "sharing" broadly, and the use of certain analytics or advertising technologies can qualify. To the extent any disclosure we make constitutes a "sale" or "sharing" under the CCPA/CPRA, you have the right to opt out.

You can opt out in either of these ways:

  • Email: send a request to nick@consultnta.com with the subject line "Do Not Sell or Share My Personal Information."
  • Global Privacy Control: enable the GPC signal in your browser or browser extension. We treat a GPC signal as a valid opt-out request for that browser, as described in Section 9.

After you opt out, we will not sell or share your personal information unless you later provide consent. We will wait at least 12 months before asking you to opt back in.

9. Global Privacy Control

We honor the Global Privacy Control (GPC) signal. If your browser or a browser extension transmits a GPC signal when you visit the Site, our analytics does not load at all for that browser, and we treat the signal as a valid request to opt out of the sale or sharing of your personal information. No further action is required on your part for the browser sending the signal. We honor the legacy Do Not Track signal the same way.

10. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this policy:

  • Website analytics (PostHog, Plausible): analytics event data is retained per our analytics providers' configured retention periods, after which it is deleted or aggregated. We periodically review these periods to keep them no longer than necessary.
  • Lead-form data: retained for as long as needed to deliver the lead to the relevant client and to support campaign reporting, then deleted or archived. The client who receives your lead maintains it under their own retention practices.
  • Correspondence and business records: retained as needed for the relationship and to meet legal, accounting, and tax obligations (project records up to 7 years).

When retention is no longer necessary, we delete, de-identify, or aggregate the information.

11. Children's Privacy

The Site and our services are directed at adults and businesses. They are not directed at children, and we do not knowingly collect personal information from anyone under 16 years of age. We do not sell or share the personal information of consumers we know to be under 16. If you believe a child under 16 has provided us personal information, contact us at nick@consultnta.com and we will delete it.

12. Changes to This Policy

We may update this policy from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, provide a more prominent notice on the Site. Your continued use of the Site after an update means the revised policy applies to you.
